Drug and Alcohol Program Setup for New Carriers

Quick answer: If you operate a truck that requires a CDL, Part 382 applies to you, including as an owner-operator (49 CFR 382.103). A one-driver company must be in a random testing pool of two or more, which in practice means joining a consortium (C/TPA). Before your first load you need a verified negative pre-employment drug test and a Clearinghouse pre-employment full query. Not having a testing program, or a random program, is an automatic failure at the new entrant safety audit (385.321).
Set it up in this order
- Choose a C/TPA (consortium/third-party administrator) and enroll every CDL driver in its random pool, including you (382.103(b); 382.107).
- Name a Designated Employer Representative (DER). This is the person who receives results and removes drivers from safety-sensitive duty. Service agents, including your C/TPA, can't act as your DER (49 CFR 40.3).
- Adopt a written policy that covers the topics in 382.601(b). Give it to each driver and get a signed receipt. Many C/TPAs supply a template.
- Register in the Clearinghouse (clearinghouse.fmcsa.dot.gov). Owner-operators must meet both the driver and employer requirements. Designate your C/TPA (382.711).
- Buy a query plan. Queries cost a flat $1.25 each, limited or full. Bundles don't expire, and a C/TPA can't buy the plan for you.
- Run a pre-employment full query for each driver, including yourself, with the driver's electronic consent, before any safety-sensitive work (382.701(a)).
- Get a pre-employment drug test. No safety-sensitive work until there's a verified negative result (382.301(a)). Pre-employment alcohol testing is optional, but if you do it, you must test everyone (382.301(d)).
- Check previous employers. Ask for 3 years of drug and alcohol history through the Clearinghouse for FMCSA-regulated employers, and directly from employers in other DOT modes (391.23(e)).
- Supervisor training. Anyone who supervises drivers needs at least 60 minutes on alcohol misuse and 60 minutes on controlled substances, one time. Keep the certificate (382.603).
Ongoing requirements
| Requirement | What it means | Rule |
|---|---|---|
| Random testing | 2026 FMCSA minimum: 50% of average driver positions for drugs, 10% for alcohol. Your consortium runs the selections. | 382.305 |
| Annual Clearinghouse query | At least once a year per CDL driver. A limited query is fine with consent. If it shows information, run a full query within 24 hours or take the driver off safety-sensitive work. | 382.701(b) |
| Post-accident testing | Fatality: always test. Injury treated away from the scene, or a tow-away, plus a citation to the CMV driver: test. | 382.303 |
| Reasonable suspicion, return-to-duty, follow-up | Required when triggered. Trained supervisors make reasonable-suspicion decisions. | 382.307–.311 |
| MIS report | Only if FMCSA asks in January. Then it's due March 15. | 382.403 |
| Records | Keep query records 3 years. Keep test records secure. | 382.701(e); 382.401 |
Automatic failures to avoid
At the new entrant safety audit, these are automatic failures: no testing program, no random program, or using a driver who refused a test, tested positive, or had an alcohol concentration of 0.04 or greater (385.321(b)). See the full list in our new entrant safety audit checklist.
